GovFetch LLC ("Company," "we," "our," or "us") respects your privacy and is committed to protecting it through our compliance with this notice. This notice describes how we collect, process, retain, and disclose personal data about you when providing services to you through our websites that link to this notice (our "Services") and our practices for using, maintaining, protecting, and disclosing that information.
This notice applies only to information we collect:
- Through the Services.
- In communications, including email, text, chat, and other electronic messages, between you and the Services.
It does not apply to information collected by:
- Us through any other means, including on any other website operated by Company that does not link to this notice; or
- Any third party, including through any application or content that may link to or be accessible from or through the Services. This includes the government websites and systems referenced above, which maintain their own privacy practices.
We may provide additional or different privacy policies that are specific to certain features, services, or activities.
Please read this notice carefully to understand our policies and practices regarding your information and how we treat it. By interacting with our Services or providing us with your information, you agree to the collection, use, and sharing of your information as described in this privacy notice. This notice may change from time to time (see Changes To Our Privacy Notice). Your continued use of the Services after we make changes as described here is deemed to be acceptance of those changes, so please check the notice periodically for updates.
Children's and Minors' Data
Our Services are intended for business and professional users and are not directed to, and we do not knowingly collect any personal data from, children under the age of 18. If we learn we have collected or received personal data from a child under 18 without verification, we will delete that information.
The Personal Data That We Collect or Process
"Personal data" is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, or business contact information.
The types and categories of personal data we collect or process include:
- Account and contact information, including name, business name, email address, phone number, and other contact information you provide.
- Account and service history, including account activity, product access, and records of your acceptance of our Terms and acknowledgment of this Notice. If paid features are introduced, this may also include subscription and transaction information.
- Approximate location, such as general location inferred from IP address through our authentication provider.
- Device information, including your IP address, authentication and session identifiers, browser type, access timestamps, and other device and usage information.
- Business profile and professional information, including business name, industry, capabilities, certifications, past performance, service areas, and procurement or grant-readiness preferences you provide, as well as feedback text, chat inputs, and support requests. When you submit an in-app support request, we attach relevant account, company, and profile information to help investigate it.
- Inferences, such as scoring output, recommendations, and other analysis GovFetch generates from the information above.
We do not request or collect sensitive personal data (such as health, biometric, racial or ethnic origin, government-issued identification numbers, or similar categories) through the Services. If this changes, we will update this policy and obtain your consent as required by applicable law. Do not include Social Security numbers, financial-account credentials, medical records, biometric identifiers, or similarly sensitive information in free-text submissions. Business certifications or eligibility information you provide may reveal information about business owners or other individuals.
We also collect:
- Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific Services feature.
- Technical and usage information. Technical information includes information about your internet connection and usage details about your interactions with the Services, such as clickstream information to, through, and from our Services (including date and time), products that you view or search for, page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page. We also collect selected usage events, such as viewing opportunities, changing opportunity states, submitting feedback, and using chat. Our hosting, authentication, and security providers may also process request, device, session, performance, and security information.
If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal information.
How We Collect Your Personal and Other Data
You Provide Information to Us
We collect information about you when you interact with our Services, such as when you create or update an account, build or update a business profile, search for opportunities, submit feedback or support requests, or communicate with us.
We may save onboarding answers and profile drafts to your account before you activate beta access or complete setup. You may also provide information through Profile Tuning judgments, structured reasons, and optional notes.
Automatically Through Our Services
As you navigate through and interact with our Services, we and our service providers automatically collect information that may include personal data, including usage details, IP addresses, authentication and session identifiers, browser and device information, access timestamps, requested URLs, usage, performance, and security data, and information collected through cookies, server logs, and security logs.
GovFetch stores pseudonymous usage events and hashed IP addresses for certain abuse-prevention checks. Onboarding answers and certain opportunity and conversation identifiers may also be saved locally in your browser to resume your session. Using this information helps us operate, secure, and improve our Services.
The technologies we use for this automatic data collection may include cookies. A cookie is a small file placed on your device when you interact with the Services, including authentication cookies necessary to keep you signed in. You may refuse to accept or disable cookies through your browser settings; if you do, some Services features may be inaccessible or not function properly.
We do not currently use a third-party cookie consent management platform. We use first-party product analytics to collect usage, performance, and security data, which helps us operate, secure, troubleshoot, and improve the Services.
From Service Providers
We obtain contracting and grant opportunity data, not personal data, from public government sources, including SAM.gov, DIBBS, and Simpler.Grants.gov. We describe this source here for completeness, even though it does not involve your personal data. We may also receive personal data from service providers that support our business, such as account and authentication information from our authentication provider, described further below.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal data:
- To provide you with the Services and any contents, features, information, products, or services that we make available through the Services.
- To operate feedback, support, and public feature-board functionality, including attaching relevant account, company, and profile information to in-app support requests to help investigate them.
- To fulfill any other purpose for which you provide the information or that we describe when you provide it, or for any other purpose with your consent.
- To provide you with notices about your account.
- To improve our Services, including by analyzing your information and creating aggregated data derived from your information, to develop, maintain, analyze, improve, and report on our Services and how users interact with them.
- To detect, investigate, prevent, and respond to fraud, abuse, security incidents, and other harmful, unauthorized, or illegal activity, and to protect the security, integrity, and availability of the Services.
- To carry out our obligations and enforce our rights arising from any contracts entered into between you and us.
- To notify you when Services updates are available and about changes to any products or services we offer or provide through them.
- To send you marketing or promotional communications about GovFetch products, services, and features, from which you can opt out at any time as described below.
The usage information we collect, whether connected to your personal data or not, helps us improve our Services and deliver a better and more personalized experience by enabling us to:
- Store information about your preferences, allowing us to customize the Services according to your individual needs and interests.
- Where enabled, use saved Profile Tuning judgments and structured reasons to personalize future opportunity scores for the relevant scoring profile.
- Speed up your searches.
- Recognize you when you return to our Services.
AI and Automated Processing Disclosure
We use artificial intelligence, including large language models operated by third-party providers, to generate scoring commentary, opinions, and chat responses, and to support platform functionality such as matching opportunities to your profile. Feedback submitted through the public feature board may be reviewed or moderated using AI tools before display. Our AI provider states that business and API data are not used to train its models by default, and we do not share your personal data with third parties for the purpose of training their models.
Who We Disclose Your Information To
We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.
We may also disclose personal data that we collect or you provide as described in this privacy notice:
- To our subsidiaries and affiliates.
- To vendors that perform services for us: our hosting and database provider; our authentication provider; our content-delivery, security, and document-storage provider; our AI provider, for scoring, analysis, chat, search and embeddings, and content moderation; and our business email and document-collaboration provider. A current list of our subprocessors is available at https://beta.govfetch.com/subprocessors. These providers are authorized to use personal data only as necessary to provide services to us or as otherwise permitted by law, and process data under applicable data processing agreements.
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of GovFetch's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by GovFetch is among the assets transferred. Any such disclosure or transfer will be subject to appropriate confidentiality protections, applicable law, and our existing privacy commitments. We will provide any legally required notice, and where a successor intends to use your personal data in a manner materially different from this notice, we or the successor will provide notice and obtain your consent where required by law.
- At your direction, through profile sharing. When you create and share a profile-transfer code, an eligible user who possesses the unused code may redeem it to create an independent copy of the included profile information. The shared snapshot may include company details, notes, labels, and personalization information, which may contain personal data. Copies do not synchronize with later changes to the original profile.
- Through the public feature board, where feature requests submitted for publication may be displayed to other users after review or moderation. Do not include confidential information or unnecessary personal information in those submissions. Support requests are not publicly displayed.
- To fulfill the purpose for which you provide it.
- For any other purpose disclosed by us when you provide the information.
- With your consent.
We may also disclose your personal data:
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
- To enforce or apply our Terms of Service and other agreements, including for billing and collection purposes.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our organization, our customers, or others.
The categories of personal data we may disclose include:
- Account and contact information.
- Device and usage information.
- Business profile and professional information you elect to provide to us.
- Inferences, such as scoring output generated from the categories above.
Your Rights and Choices About Your Information
This section describes mechanisms you can use to control certain uses and disclosures of your information and rights you may have under state law, depending on where you live.
Cookie choices:
- Cookies and Other Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when these files are being sent. If you disable or refuse cookies, some Services features may be inaccessible or not function properly.
- Promotional communications. You can opt out of marketing or promotional emails at any time by following the unsubscribe instructions in the message or by contacting us at the address in this notice. Even if you opt out, we may still send you non-promotional messages, such as account, transactional, or service-related communications.
Your State Privacy Rights
Depending on your state of residency, you may have certain rights related to your personal data, including:
- Access and Data Portability. You may confirm whether we process your personal data and access a copy of the personal data we process. To the extent feasible and required by state law, data will be provided in a portable format.
- Correction. You may request that we correct inaccuracies in your personal data that we maintain, taking into account the information's nature and processing purpose.
- Deletion. You may request that we delete personal data about you that we maintain, subject to certain exceptions under applicable law.
- Opt Out of Sales, Targeted Advertising, and Certain Profiling. GovFetch does not currently sell personal data, use it for targeted advertising, or engage in profiling producing legal or similarly significant effects. If this changes, you may request that we do not use your personal data for these purposes.
Important: The exact scope of these rights varies by state. There are also several exceptions where we may not have an obligation to fulfill your request.
To exercise applicable privacy rights, contact support@govfetch.com or use relevant account controls where available. We may verify requests through authenticated account access or other reasonable methods. We aim to respond within 30 calendar days, or sooner where required by applicable law. To appeal a decision regarding a privacy-rights request where an appeal right applies, contact the same address with the subject line “Rights Request Appeal.”
Some browsers and extensions support the Global Privacy Control (“GPC”), a signal used to opt out of certain data processing, including "sales" and “sharing” as defined under certain state laws. GovFetch does not currently sell or share personal data or use it for targeted advertising, so there is no such opt-out for a GPC signal to apply to at this time. If our practices change, we will treat a detected GPC signal as a request to opt out and will honor it as required by applicable law.
How We Protect Your Personal Data
We implement and maintain reasonable administrative, technical, and physical safeguards designed to protect the security, confidentiality, and integrity of personal information collected through the Services. These measures include encryption of personal data in transit (using TLS/SSL) and at rest, role-based access controls that limit access to personal data to authorized personnel, and pseudonymization or anonymization of certain data where appropriate. In the event of a breach of security involving personal information, GovFetch will notify affected individuals in accordance with applicable law. No website, platform, system, or method of transmission is completely secure.
The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, and access.
How We Retain Your Personal Data
We keep the categories of personal data described in this notice for as long as reasonably necessary to fulfill the purposes described. Current retention practices include: product analytics events, retained for 90 days; pending onboarding submissions, which expire 30 days after confirmation or reconfirmation, with associated content redacted and remaining records deleted 30 days thereafter; and chat records, subject to a 365-day retention setting. Retention periods for other categories of personal data described in this notice are determined based on the purposes for which the data was collected and applicable legal requirements. At the end of the applicable retention period, personal data will be deleted, destroyed, or deidentified.
Changes to Our Privacy Notice
We may update this notice from time to time, and we will provide notice of any such changes to the notice as required by law. The date the privacy notice was last updated is identified at the top of the page. We will notify you of changes to this notice by updating the "last updated" date and posting the updated notice on the Services. We may email or otherwise communicate reminders about this notice, but you should check our Services periodically to see the current notice and any changes we have made to it.
